Privacy Policy

Switchly is a Canadian job board for francophone job seekers, operated by PickYourShift Inc. This policy explains what personal information we collect, why, who we share it with, and what you can do about it. It applies to switchly.ca and every page on it.
1. Who is responsible

2. What we collect
If you are looking for work, you can browse and search without giving us anything. No account is required.
If you apply through our application form, we collect your first name, last name, email address, phone number if you provide one, and any message you write.
If you apply by email or WhatsApp instead, we record that a person clicked the apply button on that posting. We do not see your message, your address, or who you are.
If you are an employer, we collect your business name, your name, your work email, your phone number if you provide one, your street address, city, province and postal code, and a password that we store only as a cryptographic hash. We never store your password itself.
We also keep records of your orders: what you bought, when, the amount, and the invoice number.
Automatically, our servers record your IP address, browser type, the pages you visit, and the time of your visit. Google Analytics collects similar information through cookies. See our Cookie Policy.
We do not collect your immigration status, work permit type, date of birth, social insurance number, or any government identifier. We have deliberately chosen not to.
3. Payment information
We do not see or store your card details. Payments are processed by Stripe, which handles the card information directly. We receive only a confirmation, the amount, and a transaction reference. Stripe's own privacy policy governs what it does with that information.
4. Why we collect it
Applications so we can pass them to the employer whose job you applied for.
Employer accounts so you can sign in, post jobs, and receive invoices.
Apply click counts so employers can see whether their posting worked. These are counts, not identities.
Analytics so we can see which pages are used and improve them.
Server logs for security, to detect abuse, and to fix faults.
Invoices and order records because Canadian tax law requires us to keep them.
5. What happens to your application
When you apply through Switchly, your application is sent to the employer who posted the job.
From that point the employer decides what happens to it. They are responsible for their own handling of your information, and their practices are not covered by this policy. If you want your application removed from an employer's records, contact the employer directly.
We keep a copy so the employer can see it in their dashboard. See retention below.
6. Who we share it with
We do not sell personal information. We have never done so and will not.
We share it only with employers, when you apply to their posting; Stripe, to process payments; Google, through Google Analytics, which receives your IP address and browsing behaviour on our site; our hosting provider, GoDaddy, which stores our database and files; and anyone we are legally required to disclose to, such as under a court order or a lawful request from an authority.
7. Where your information is stored
Our servers are located in the United States, in Phoenix, Arizona.
This means your personal information is stored outside Canada and may be subject to access by United States authorities under United States law, including lawful access requests, regardless of the protections that apply in Canada.
Google Analytics and Stripe also process information outside Canada.
We have assessed this transfer and consider the protections adequate for the information involved, taking into account its sensitivity, the purposes it is used for, the safeguards in place, and the legal framework of the destination country. You may contact our Privacy Officer for more information about that assessment.
8. How long we keep it
Applications: 12 months after the job posting closes, then deleted.
Employer accounts: for as long as the account is open. If you close your account we delete your profile, keeping only what tax law requires.
Invoices and order records: 7 years, as required by Canadian tax law.
Server logs: approximately 90 days.
Apply click counts: indefinitely. These are numbers with no personal information attached.
9. How we protect it
Connections to switchly.ca are encrypted with HTTPS. Passwords are stored using a one-way cryptographic hash and are never readable, including by us. Forms are protected against cross-site request forgery. Sign-in attempts are rate limited. Access to the database is restricted to people who need it to operate the service.
No system is perfectly secure. If a breach occurs that presents a risk of serious harm, we will notify you and the appropriate authorities as required by law.
10. Your rights
You have the right to know what personal information we hold about you, to access a copy of it, to correct anything inaccurate or incomplete, to withdraw consent including for analytics cookies at any time, to delete your information subject to records we must keep by law, and, if you are in Quebec, to receive your information in a structured, commonly used technological format.
You may also complain, to us first, and then to the Office of the Privacy Commissioner of Canada, or to the Commission d'acces a l'information du Quebec if you are in Quebec.
To exercise any of these, email privacy@switchly.ca. We will respond within 30 days.
11. Automated decisions
We do not use automated decision-making or profiling to make decisions about you. Employers decide who to contact. We do not rank, score, or filter candidates.
12. Children
Switchly is intended for people legally permitted to work in Canada. We do not knowingly collect personal information from children under 14. If you believe a child has provided us with information, contact privacy@switchly.ca and we will delete it.
13. Changes
We may update this policy. If we make a material change we will update the date at the top and, where the change is significant, tell you before it takes effect.
