Terms of Service

These terms govern your use of switchly.ca. By using the site you agree to them. If you do not agree, do not use the site. Switchly is operated by PickYourShift Inc., a Canadian company.
1. What Switchly is
Switchly is a job board. We publish job postings written by employers and make them findable by job seekers.
We are not an employer, a recruiter, or an employment agency. We do not screen candidates, verify job postings beyond basic checks, participate in hiring decisions, or guarantee that any posting will lead to employment.
The relationship in any hiring is between the employer and the candidate. We are not a party to it.
2. Using Switchly as a job seeker
Browsing and applying are free, and always will be. No account is required.
You agree to provide accurate information in any application you send, and to use the site only to look for work for yourself.
You may not use automated tools to scrape, copy or collect postings or contact details from this site.
We do not guarantee the accuracy of any posting. Postings are written by employers. If something looks wrong, tell us at support@switchly.ca.
3. Using Switchly as an employer
Your account. You must give accurate business information and keep it current. You are responsible for what happens under your account and for keeping your password secure.
Your postings. Every posting must be for a real, current job opening. You must not:
- Post a job that does not exist, or use a posting to collect resumes for future use
- Charge candidates any fee to apply, be considered, be trained, or be hired
- Post multi-level marketing, commission-only recruiting schemes, or business opportunities presented as employment
- Post discriminatory requirements contrary to applicable human rights legislation
- Post content that is illegal, misleading, offensive, or infringes anyone's rights
- Include another company's branding or claim to represent an employer without authorisation
- Post the same job repeatedly to gain visibility
We may remove any posting that breaches these terms, or suspend an account, without refund.
Candidate information. Personal information you receive through Switchly may be used only to consider that person for that job. You must not add candidates to marketing lists, sell their information, or use it for any unrelated purpose. You are independently responsible for complying with privacy law in your handling of it.
4. Payments, credits and refunds
Prices are in Canadian dollars. GST is added at checkout.
When you buy a package you receive posting credits. One credit publishes one job posting for the duration stated at the time of purchase.
Refunds. All purchases are final. Posting credits are non-refundable once purchased, whether or not you have used them.
The one exception is a payment taken twice. If you are charged more than once for the same order, contact support@switchly.ca and we will refund the duplicate.
If we remove a posting for breaching these terms, no refund is given.
Credits are tied to your account and cannot be transferred or sold.
Prices may change. A change never affects credits you have already bought.
5. Availability
We aim to keep Switchly available, but we do not guarantee uninterrupted service. We may suspend the site for maintenance, and we may change or discontinue features.
6. Our content
The Switchly name, logo, design, and the software behind the site belong to PickYourShift Inc. You may not copy, reproduce or reuse them without permission.
Job postings belong to the employers who wrote them. By posting, you give us permission to publish, display, and distribute that posting on our site and through search engines, in both English and French.
7. Limitation of liability
To the fullest extent permitted by law, Switchly is provided as is, without warranties of any kind.
We are not liable for any loss arising from your use of the site, including lost opportunities, lost earnings, hiring decisions, the conduct of any employer or candidate, or the accuracy of any posting.
Where liability cannot be excluded, our total liability to an employer is limited to the amount that employer paid us in the 12 months before the claim. For job seekers, who pay nothing, it is limited to CAD $100.
Nothing here excludes liability that cannot be excluded under applicable consumer protection law.
8. Indemnity
If your use of Switchly causes a claim against us, you agree to cover our reasonable costs in dealing with it. This applies particularly to employers whose postings or handling of candidate information give rise to a claim.
9. Ending your use
You may stop using Switchly at any time, and employers may close their account by contacting us.
We may suspend or close an account that breaches these terms.
Closing an account does not remove postings already published during their paid term, and does not entitle you to a refund of used credits.
10. Governing law
These terms are governed by the laws of the Province of Alberta and the laws of Canada that apply there. Disputes are subject to the courts of Alberta, except where consumer protection law in your own province gives you the right to bring a claim there.
11. Changes
We may update these terms. The date at the top shows when. Continuing to use Switchly after a change means you accept it. If a change materially affects employers who have bought credits, we will tell them before it takes effect.
